Le Professeur Thirlway, Visiting Professor à l’Université de Bristol, décrit dans son cours en quoi le droit international est différent des systèmes juridiques internes. Le professeur Thirlway commence par décrire la réalité du droit international, après quoi il s’intéresse au concept de sources du droit international (traité, coutume, principes généraux, … ). Le professeur Thirlway s’intéresse ensuite à certains concepts clés du droit international, particulièrement aux notions de sujets de droit et de territoire. Le dernier chapitre du cours est consacré à des types de normes particulières : soft law, obligations erga omnes et jus cogens.
Professor Thirlway, Visiting Professor at the University of Bristol, examines in this course how and why it is that international law is different from all other national systems of law. Professor Thirlway starts by describing the reality of international law, and then focuses on the concept of the sources of international law (treaties, customs, and general principles of law). The author then lists some major concepts of international law, in particular the notions of the subjects of law and territory. The last chapter is devoted to some varieties of law: soft law, obligations erga omnes and jus cogens.
